GENERAL TERMS AND CONDITIONS OF SALE

 

ARTICLE 1. PREAMBLE

These terms and conditions of sale are concluded, on the one hand, by The Hunter Camp (VALAPI SRL), whose registered office is located at 7, Chemin Longues Aulnes, 1430 Rebecq, registered with the Banque Carrefour des Entreprises under number BE0770425963, hereinafter referred to as "the company," and, on the other hand, by any natural or legal person wishing to purchase via the company's website, hereinafter referred to as "the buyer."

The Hunter Camp's primary activity is the marketing of hunting accessories.

The General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties in the context of product sales by The Hunter Camp on the Site.

The GTCS are the only applicable terms and replace all other conditions, except for any prior, express, and written agreement from The Hunter Camp.

At any time, The Hunter Camp reserves the right to adapt or modify certain points of the GTCS. Consequently, it is necessary to review the version in effect on the day of placing the order on the Site. These adaptations or modifications are binding on the user from the time they are posted online and will apply to orders placed after they are posted online.

This version of the general terms and conditions is dated March 18, 2025.

A printed version of these provisions and any warning notices delivered electronically will be accepted in any judicial or administrative proceedings related to this agreement, under the same conditions as other business documents and records created and maintained in printed form.

ARTICLE 2. SITE AVAILABILITY

The Hunter Camp strives, as far as possible, to keep its services accessible 7 days a week and 24 hours a day.

However, The Hunter Camp may interrupt access, whether scheduled or not, particularly for maintenance and upgrades or for any other reasons, especially technical ones.

ARTICLE 3. ONLINE REGISTRATION

To access the online services made available to the internet user via www.thehuntercamp.com, particularly the ordering process, the internet user must register online.

During registration, the internet user is invited to provide information about themselves. The internet user certifies that the information they agree to provide is true, accurate, up-to-date, and complete.

If the internet user wishes to modify information about themselves, they are invited to do so without delay by logging into their user profile called "My Account," especially before initiating an ordering process. The internet user acknowledges that the information in their user profile is up-to-date and that they assume responsibility for this update.

Before each order validation, the new user of the site acknowledges adherence to these general terms and conditions by checking the corresponding box. Without this validation, the registration process cannot be completed.

The registered internet user (hereinafter the user) who wishes to unsubscribe must send an email to the following address: hello@thehuntercamp.com. The Hunter Camp undertakes to unsubscribe them within 72 hours and to send the consumer an email confirming their unsubscription. By unsubscribing, the user acknowledges that the unsubscription does not affect the reciprocal obligations arising from the prior use of the services of www.thehuntercamp.com by the user.

ARTICLE 4. USER PROFILE, REFERRAL, AND USER STATUS

By accessing their user profile "My Account," the user can access the personal information they agreed to provide during their online registration. The user can freely modify the information about themselves. The user can also track the order process(es) they have initiated, as well as learn about their category and associated information, the number of purchases made, and the content of their virtual wallet.

ARTICLE 5. PRODUCT DESCRIPTION

The products displayed on the "The Hunter Camp" site are available for sale. The Hunter Camp provides the Client, for information purposes, with a descriptive sheet and images of the products offered for sale. The products are offered for sale for an indefinite period.

Additionally, The Hunter Camp is not responsible for visual alterations caused by the computer equipment chosen by the user to access the www.thehuntercamp.com site. Consequently, the user expressly waives invoking their warranty rights in the specific case where the purchased product does not match the product image viewed online by the user through their computer equipment but does match the product description posted online by The Hunter Camp.

ARTICLE 6. PRICE INDICATION

The prices mentioned on the site use the EURO and include the applicable VAT. The Client's payment currency may differ from the currency in which the prices are displayed. If the Client's banking institution applies an exchange rate to the transaction between the client and the payment provider, the client will exclusively bear the exchange fees applied by their banking institution.

The costs related to the shipment of products ordered by the user are mentioned when choosing the delivery method and are recalled in the order summary screen.

The Hunter Camp reserves the right to modify the prices of products present on the site and the mentioned fees at any time in case of modification of the applicable VAT rate, fluctuation of production or logistics costs, or for any other reason.

Visiting the site may require the use of cookies. The user acknowledges that certain prices appearing online may result from the use of these cookies and that they assume the correct use of these. Consequently, The Hunter Camp cannot be held responsible for a discrepancy between the price first seen by the user and the price requested in the order summary before validation.

The Hunter Camp certifies that the prices, fees, and VAT indicated in the order summary are correct and up-to-date and correspond to the amount that will be requested from the user. This amount is available in the screen summarizing the order as well as in the email that will be sent to the user after order validation.

ARTICLE 7. ORDER PROCESS

Orders are exclusively placed through the www.thehuntercamp.com site.

When validating the contents of their cart, the Client will be redirected to a window allowing them to fill in the fields necessary for the proper processing of the order (Name, First Name, Billing/Delivery Address, email, and phone) to continue placing the order.

The order is confirmed, and the reciprocal obligations between the contracting parties exist only after the payment transaction is validated by the payment provider.

Any order accepted by The Hunter Camp will result in an email confirmation of purchase sent to the Client at the email address used to place the order, summarizing the products ordered and the delivery address. It is the client's responsibility to ensure that the confirmation email sent by The Hunter Camp is not blocked by an email filtering device. The Hunter Camp cannot be held responsible for the blocking or deletion of the confirmation email, regardless of the device involved.

Before proceeding with an online order, the user must log into their user account. If an internet user is not yet registered, it is imperative to do so before continuing to use the services associated with the site.

Only the confirmation email guarantees the client the availability of the ordered product.

The Hunter Camp reserves the right to cancel an order if the client commits payment fraud or any other criminal fraud.

ARTICLE 8. PAYMENT AND RETENTION OF TITLE

The Hunter Camp undertakes to take all reasonable measures to secure the services it offers via the site.

Payment for products ordered by the user is made via the payment provider chosen by The Hunter Camp. The Hunter Camp reserves the right to change the payment provider at any time. In the event of such a change, it will be mentioned in the corresponding version of the General Terms and Conditions of Sale. The user acknowledges acceptance of the change of payment provider by entering into any ordering process following the change indicated in the general conditions.

The current payment provider is Stripe (https://stripe.com/be).

The Hunter Camp cannot be held responsible for any losses or damages resulting from any attempt to pay using a method not mentioned in the General Terms and Conditions of Sale.

The cost of payment fees depends on the rates applied by the payment provider.

The Hunter Camp cannot be held responsible for the pricing and/or technical choices of the payment provider. The user acknowledges and accepts these unreservedly. In the event of a payment-related dispute, only the payment provider may be held responsible.

The user is invited to read the conditions governing the use of the payment solutions offered by the provider, as well as the usage terms. These conditions and usage terms are available from the payment provider. By accepting payment through the provider, the user fully agrees to the terms governing the use of the provider's services.

The Hunter Camp reserves the right to refuse any order in the case of proven fraud or if the payment process is interrupted by the payment provider or the user, directly or indirectly.

The Hunter Camp also reserves the right to refuse any order from a user with whom The Hunter Camp is in a legal dispute, regardless of the nature of the dispute.

In the event of a payment refusal notified to the client, particularly due to incorrect bank details or insufficient account balance, the client shall bear all costs associated with resolving the issue, including those incurred by third parties.

ARTICLE 9. PRODUCT AVAILABILITY

Product offers are valid as long as they are visible on the Site. The Hunter Camp undertakes to take all useful measures to provide the services it offers via the site. Product availability depends on stock levels.

Once an order is accepted, a confirmation email will be sent to the Client, summarising the ordered products.

Only the receipt of the purchase confirmation email from The Hunter Camp guarantees product availability.

However, after the order has been placed, The Hunter Camp reserves the right to suspend the sale of a product in the event of unavailability. In such cases, The Hunter Camp will inform the Client as soon as possible by email or phone and offer the Client the option to cancel the order or receive store credit.

If the Client cancels the order, The Hunter Camp will refund the amount paid using the same bank card used for the purchase within thirty (30) days of the Client's decision.

ARTICLE 10. DELIVERY

All orders can be delivered worldwide.

Delivery of products ordered by the user is carried out by the delivery provider chosen by The Hunter Camp. The Hunter Camp reserves the right to change the delivery provider at any time. In case of change, this will be clearly stated in the relevant version of the General Terms and Conditions of Sale. The user acknowledges acceptance of the change of delivery provider by proceeding with any ordering process after the stated modification.

Deliveries are made within a time frame indicated on the site at the time of order confirmation. This period is calculated in business days (Monday to Friday, excluding public holidays). If the customer wishes to change the delivery address after placing the order, they must send an email to The Hunter Camp customer service as soon as possible at hello@thehuntercamp.com, referencing the order number, the relevant product, and the new delivery address. The Hunter Camp will then, depending on the progress of the order, confirm or deny the change via email.

In the event of the customer's absence at the time of delivery, delivery impossibility, or resulting damage due to inaccurate information provided by the client, The Hunter Camp and the carrier cannot be held individually or collectively responsible. All costs (return of goods, storage) resulting from the customer's absence, delivery impossibility, or inaccuracies will be borne exclusively by the client and must be settled before any re-delivery.

When ordering, The Hunter Camp offers the "Home Delivery" option. The cost of delivery depends on the rates set by the delivery provider.

The Hunter Camp cannot be held responsible for the pricing and/or logistics choices of the delivery provider. The user acknowledges acceptance of these without reservation. In the event of a delivery-related dispute, only the delivery provider may be held responsible.

The user is invited to review the terms governing the use of the delivery provider's solutions and the terms of use. These are available from the delivery provider. By accepting delivery through the provider, the user fully agrees to the conditions governing the use of the provider's services.

ARTICLE 11. RIGHT OF WITHDRAWAL

All site users have a right of withdrawal that can be exercised without justifying. According to applicable law, the right of withdrawal only applies to products that legally allow such a right.

The withdrawal period is fourteen calendar days from the day following the receipt of the order by the user. The user bears the burden of proof for this date.

To exercise the right of withdrawal, the user must notify The Hunter Camp by email at hello@thehuntercamp.com. The date of this email constitutes the effective exercise of the right of withdrawal. In the event of withdrawal within the specified period, only the price of the returned product and the shipping fees indicated in the order will be refunded. Return costs and risks are the sole responsibility of the client.

All returned products must be in their original and complete condition (packaging, accessories, manuals, etc.) to allow resale. A copy of the invoice or order confirmation must also be returned with the product.

All returned products must be sent to the following address: The Hunter Camp (Valapi SRL), Chemin Longues Aulnes, 7, 1430 Rebecq, Belgium.

Incomplete or used products will not be accepted under the right of withdrawal.

Refunds following the exercise of the right of withdrawal will be processed within thirty days of the appropriate form’s validation. The refund will be made via the payment provider and under their standard procedures.

To exercise the right of withdrawal, the user agrees to use only the "Home Delivery" system provided by The Hunter Camp. The user also acknowledges that they will notify The Hunter Camp of their decision by filling in the appropriate form available on the site. More details can be found on the FPS Economy website.

ARTICLE 12. WARRANTY

The Hunter Camp provides a contractual warranty for defects found in delivered products, upon proof of purchase date. The invoice will be issued to the customer’s account.

In the event of a reported defect, the client must notify The Hunter Camp via registered letter with acknowledgment of receipt, sent to: The Hunter Camp – Customer Service – Address: 7, Chemin Longues Aulnes, 1430 Rebecq, Belgium. This must be accompanied by photographic evidence.

Before approving warranty coverage, The Hunter Camp will verify:

  • That the product matches the product ordered, without damage or specific modifications,

  • That the reported defect does not result from abnormal use, normal wear, or an accidental event potentially caused by a third party.

If warranty coverage is approved, The Hunter Camp agrees to refund or exchange the defective products.

The Hunter Camp will handle the return procedures and cover the related costs under this warranty.

Any refund approved by The Hunter Camp will be made to the card used for the purchase within thirty days of receiving the returned product.

ARTICLE 13. INTELLECTUAL PROPERTY RIGHTS

All elements of the site, whether visual or audio, are the exclusive property of The Hunter Camp and are protected by copyright law. Consequently, any total or partial reproduction of the site without The Hunter Camp’s express consent is prohibited and constitutes infringement.

ARTICLE 14. CONTENT AND LIABILITY DISCLAIMER

The client is responsible for entering and verifying their information at every stage of the order process and in all stages following the conclusion of the contract.

The Hunter Camp is not responsible for the information provided by the client at any stage.

The Hunter Camp does not guarantee order acceptance and is not liable in the event of product unavailability, except to refund the price of the ordered product.

The Hunter Camp accepts no liability for indirect, special, or consequential damages arising from the contract.

The Hunter Camp is not responsible for service interruptions on the site or any consequences thereof for the user or third parties.

The Hunter Camp undertakes to take all reasonable steps to ensure the site’s information is complete and accurate. However, it does not guarantee the accuracy or updates of the information, except for prices listed in the order summary before validation.

The Hunter Camp cannot guarantee that all functional aspects of the site are free from execution errors on the user's chosen equipment. However, it ensures that the site's content contains no harmful components.

The Hunter Camp is not responsible for damage resulting from unauthorized access to its IT systems and/or fraudulent use of its distribution methods. It disclaims all responsibility in case of data theft from such intrusions, though it implements appropriate measures to prevent unlawful access.

By using the internet or any form of remote communication to view the site and access its services, the user acknowledges being fully aware of the inherent risks of internet use. The Hunter Camp shall not be held liable for the presence of viruses or harmful content on the internet that may damage user equipment. The Hunter Camp recommends always using up-to-date antivirus and anti-malware software. Each user is responsible for ensuring the integrity of the device used to access the site and its services.

The user is solely responsible for the security and confidentiality of their password. In the event of unauthorized use, users agree to notify The Hunter Camp at hello@thehuntercamp.com. The Hunter Camp will then deactivate the concerned account without delay and inform the user via email. Until this notification, the user acknowledges full responsibility for any misuse.

The user is solely responsible for saving emails received and/or exchanged with The Hunter Camp.

The Hunter Camp reserves the right to include hyperlinks to third-party websites. It cannot verify all content on these sites and disclaims all responsibility for them, including materials, data, processing of personal data, and their availability.

Users explicitly acknowledge that no representatives, employees, or agents of The Hunter Camp can be held liable for any damage resulting from the use of the site and its services.

ARTICLE 15. PRESERVATION OF RIGHTS AND JURISDICTION

The Hunter Camp reserves the right to take legal action in case of violation of these terms to seek compensation for potential damages.

Subject to public and private international law provisions, Belgian law governs the relationship between The Hunter Camp and the user.

Only the courts of Brussels shall have jurisdiction.

The Hunter Camp also reserves the right to deny any user access to all or part of the site, unilaterally and without prior notice, especially in the event of a clear violation of these terms.

ARTICLE 16. MISCELLANEOUS

The user expressly acknowledges that the sales contract is concluded in Belgium and that the contractual language is French.

If any provision of these terms is declared invalid or unenforceable under applicable law, that provision will be replaced by a valid and enforceable one that comes as close as possible to the intent of the original provision, and the remaining provisions will remain in effect.

These provisions and the Personal Data Policy constitute the entire agreement between users and The Hunter Camp regarding the site and associated services. They supersede all previous or contemporaneous communications and proposals, whether electronic, written, or oral, between the parties.
