General Terms and Conditions of Sale

Article 1. Preamble

These sales conditions are concluded, on the one hand, by The Hunter Camp (VALAPI SRL) whose registered office is located at 7, Chemin Longues Aulnes 1430 Rebecq, registered with the Crossroads Bank for Enterprises under number BE0770425963 hereinafter referred to as "the company" and, on the other hand, by any natural or legal person wishing to make a purchase via the company's website, hereinafter referred to as "the buyer".

The Hunter Camp's main activity is the marketing of hunting accessories.

The General Terms and Conditions define the rights and obligations of the parties in the context of the sale of products by The Hunter Camp on the Site.

The General Terms and Conditions are the only applicable ones and replace all other conditions, unless otherwise agreed in advance, expressly and in writing by The Hunter Camp.

At any time, The Hunter Camp reserves the right to adapt or modify certain points of the General Terms and Conditions. Consequently, it is necessary to be aware of the version in effect on the day the order is placed on the Site. These adaptations or modifications are binding on the user from the moment they are published online and will apply to orders placed after their publication.

A printed version of these provisions and any warning notice issued in electronic form will be accepted in any judicial or administrative proceedings related to this agreement, on the same basis and under the same conditions as other documents and business records created and maintained in printed form. 

Article 2. Site Availability

The Hunter Camp strives, as much as possible, to keep its services accessible 7 days a week and 24 hours a day.

However, The Hunter Camp may interrupt access, whether scheduled or not, particularly for maintenance and upgrades or for any other reasons, including technical ones.

Article 3. Online Registration

In order to access the online services made available to users viawww.thehuntercamp.comincluding the ordering process, users must register online.

During registration, users are invited to provide information about themselves. Users certify that the information they consent to provide is true, accurate, up-to-date, and complete.

If users wish to modify information about themselves, they are invited to do so promptly by logging into their user profile named "My Account," particularly before initiating an ordering process. Users acknowledge that the information in their user profile is up-to-date and that they assume responsibility for this update.

Before each order confirmation, new users of the site acknowledge their acceptance of these general terms by checking the corresponding checkbox. If not validated, the registration process cannot be completed.

The registered internet user (hereinafter referred to as the user) who wishes to unsubscribe must send an email to the following address:hello@thehuntercamp.com. The Hunter Camp commits to unsubscribe them within 72 hours and to send the consumer an email confirming their unsubscription. By unsubscribing, the user acknowledges that the unsubscription has no effect on the mutual obligations arising from the previous use of the services bywww.thehuntercamp.comthe user.

Article 4. User Profile, Sponsorship, and User Status

By accessing their user profile "My Account", the user can access the personal information they consented to provide during their online registration. The user can freely modify the information concerning them. The user can also track the order process they initiated as well as learn about their category and the associated information, the number of purchases made, and the content of their virtual wallet.

Article 5. Product Description

The products displayed on the "The Hunter Camp" site are available for sale. The Hunter Camp provides the Client, for informational purposes, a descriptive sheet and images of the products offered for sale. The products are offered for sale for an indefinite duration.

Additionally, The Hunter Camp is not responsible for visual alterations caused by the computer equipment chosen by the user to access the site.www.thehuntercamp.com. Consequently, the user expressly waives the right to invoke their warranty in the specific case where the purchased product does not correspond to the image of the product seen online by the user through their computer equipment but corresponds to the description of the product posted online by The Hunter Camp.

Article 6. Price Indication

The prices mentioned on the site are in EURO and include applicable VAT. It is possible that the customer's payment currency differs from the currency in which the prices are displayed. In the event that the customer's bank applies an exchange rate to the transaction between the customer and the payment provider, the customer will exclusively bear the exchange fees applied by their bank.

The shipping costs for the products ordered by the user are mentioned when choosing the delivery method and are reiterated on the order summary screen.

The Hunter Camp reserves the right to modify the prices of the products on the site and the mentioned fees at any time in the event of a change in the applicable VAT rate, fluctuations in production or logistics costs, or for any other reason.

Visiting the site may require the use of cookies. The user acknowledges that some prices appearing online may result from the use of these cookies and that they assume the correct use of them. Therefore, The Hunter Camp cannot be held responsible for any discrepancy between the price initially seen by the user and the price requested during the order summary before validation.

The Hunter Camp certifies that the prices, fees, and VAT indicated during the order summary are correct and up to date, and correspond to the amount that will actually be charged to the user. This amount is available on the order summary screen as well as in the email that will be sent to the user after the order is validated.

Article 7. Ordering Process

Orders are exclusively placed through the website.www.thehuntercamp.com.

When validating the contents of their cart, the Customer will be redirected to a window allowing them to fill in the necessary fields for the proper processing of the order (First Name, Last Name, Billing/Shipping Address, email, and phone) in order to continue with the order placement.

The order is confirmed and the mutual obligations between the contracting parties only exist after the payment transaction is validated by the payment provider.

Any order accepted by The Hunter Camp will result in the sending of a purchase confirmation email to the Customer at the email address used to place the order, summarizing the ordered products and the delivery address. It is the customer's responsibility to ensure that the confirmation email sent by The Hunter Camp is not blocked by an email filtering device. The Hunter Camp cannot be held responsible for the blocking or deletion of the purchase confirmation email, regardless of the device involved.

Before proceeding with an online order, the user must log in to their user account. If a user is not yet registered, it is imperative that they do so before they can continue to use the services associated with the site.

Only the purchase confirmation email guarantees the customer the availability of the ordered product.

The Hunter Camp reserves the right to cancel an order if the customer commits payment fraud or any other criminal fraud.

Article 8. Payment and retention of title

The Hunter Camp is committed to taking all reasonable measures to secure the services it offers through the site.

Payment for the products ordered by the user is made by the payment provider chosen by The Hunter Camp. The Hunter Camp reserves the right to change the payment provider at any time. In the event of a change, it will be clearly mentioned in the corresponding version of the general terms and conditions of sale. The user acknowledges acceptance of the change in the choice of payment provider by entering into any order process subsequent to the change indicated in the general terms.

The current payment provider is the company Stripe (https://stripe.com/be).

The Hunter Camp cannot be held responsible for losses and any damages resulting from any attempt to pay by a means other than those mentioned in the General Terms and Conditions of Sale.

The cost of payment fees depends on the rates charged by the payment provider.

The Hunter Camp cannot be held responsible for the pricing and/or technical choices of the payment provider. The user acknowledges acceptance of these without reservation. In the event of a dispute related to payment, only the payment provider may be held liable.

The user is invited to familiarize themselves with the terms governing the use of the payment solutions provided by the payment service provider as well as the methods of using these solutions. These terms and methods of use are available from the payment service provider. By accepting the payment for their order through the payment service provider, the user acknowledges full adherence to the terms governing the use of the services of the payment service provider.

The Hunter Camp reserves the right to refuse an order in the event of proven fraud or if the payment process is interrupted by the payment service provider or by the user, either directly or indirectly.

The Hunter Camp also reserves the right to refuse an order from a user with whom The Hunter Camp is in dispute, regardless of the form of the dispute.

In the event of a payment refusal communicated to the customer due to, among other things, incorrect entry of bank details or insufficient account balance, the customer will bear all costs associated with resolving the issue, including costs incurred by any third parties.

Article 9. Product Availability

Product offers are valid as long as they are visible on the Site. The Hunter Camp is committed to taking all necessary measures to fulfill the services it provides through the site. The availability of products depends on available stock.

Upon acceptance of an order, a purchase confirmation email will be sent by The Hunter Camp to the Customer who placed the order, summarizing the products ordered.

Only the receipt of the purchase confirmation email from The Hunter Camp guarantees the availability of the product.

However, after placing the order, The Hunter Camp reserves the right to suspend the sale of a product in case of unavailability. In this event, The Hunter Camp will inform the Customer as soon as possible by email or phone and will offer the Customer either to cancel their order or to receive a credit.

In the event of cancellation by the Customer of their order, The Hunter Camp will refund the amount paid by the Customer at the time of the order to the credit card used within a maximum of thirty (30) days from the Customer's decision.

Article 10. Delivery

Any delivery of an order can be made worldwide.

The delivery of products ordered by the user is carried out by the delivery service provider chosen by The Hunter Camp. The Hunter Camp reserves the right to change the delivery service provider at any time. In the event of a change, it will be clearly mentioned in the corresponding version of the general terms and conditions of sale. The user acknowledges acceptance of the change in the choice of delivery service provider by entering into any order process subsequent to the change indicated in the general terms.

Deliveries are made within a timeframe indicated by The Hunter Camp on the site at the time of order confirmation. This timeframe is calculated in business days (Monday to Friday, excluding public holidays). In the event that the customer wishes to change the delivery address after placing their order, they must send an email to The Hunter Camp's customer service as soon as possible at the following address:hello@thehuntercamp.comby recalling the order number, the product concerned, and specifying the new delivery address. The Hunter Camp will then send, depending on the status of the Customer's order, a confirmation email authorizing or refusing the change of the delivery address.

In case of the customer's absence during delivery, inability to deliver, or damages resulting from it due to inaccuracies in the information provided by the customer, The Hunter Camp and the carrier cannot be held responsible individually or collectively. All costs (return of products, storage) resulting from the customer's absence at delivery, inability to deliver, or inaccuracies from the customer will be the sole responsibility of the customer and must be settled before any re-delivery of the product.

When placing the order, The Hunter Camp offers the customer the "Home Delivery" option. The cost of delivery fees depends on the rates charged by the delivery service provider.

The Hunter Camp cannot be held responsible for the pricing and/or logistical choices of the delivery service provider. The user acknowledges acceptance of these without reservation. In case of a dispute related to delivery, only the delivery service provider can be declared responsible.

The user is invited to familiarize themselves with the conditions governing the use of delivery solutions as well as the methods of using these solutions. These conditions and methods of use are available from the delivery service provider. By accepting delivery through the delivery service provider, the user acknowledges full adherence to the conditions governing the use of the services of the delivery service provider.

Article 11. Right of withdrawal

Every user of the site has a right of withdrawal that can be exercised without giving any reason. In accordance with applicable legislation, the right of withdrawal can only be exercised for products to which the law attaches such a right.

The withdrawal period is fourteen calendar days from the day after the date of receipt of the order by the user. The burden of proof of this date is borne by the user.

In order to exercise their right of withdrawal, the user must inform The Hunter Camp by email.hello@thehuntercamp.com. The email sent will constitute the effective date of exercise of the customer's right of withdrawal. In the event of exercising this right of withdrawal within the aforementioned period, only the price of the returned product and the delivery costs indicated in the order will be refunded. The costs and risks of return will remain the sole responsibility of the customer.

Any return of a product under this article must be made in the original and complete condition of the product (packaging, accessories, instructions, etc.) in order to allow for resale. A copy of the sales invoice or order confirmation must also be returned with the product.

Any returned product must be shipped to the following address: The Hunter Camp (Valapi SRL) Chemin Longues Aulnes, 7, 1430 Rebecq Belgium.

Any returned product that is incomplete or used will not be accepted under the right of withdrawal.

The refund resulting from the exercise of the right of withdrawal will be made within thirty days following the validation of the appropriate form. This refund will be made through the payment service provider and according to the terms in effect with them.

To exercise the right of withdrawal, the user acknowledges using exclusively the "home delivery" system chosen by The Hunter Camp. The user also acknowledges that they will inform The Hunter Camp of their decision to initiate the exercise of their right of withdrawal by filling out the appropriate form available on the site. Article 12. Warranty

The Hunter Camp provides a contractual warranty for defects found on delivered products, upon proof of the purchase date. The invoice will be issued in the customer's account.

In case of a defect reported by the customer, the customer must inform The Hunter Camp by registered letter with acknowledgment of receipt in the manner detailed at the following address: The Hunter Camp – Customer Service – Address: 7, Chemin Longues Aulnes, 1430 Rebecq – Belgium and must be accompanied by photographic evidence.

Before agreeing to take charge of the product under warranty, The Hunter Camp will carry out the following checks:

– The product conforms to the product ordered by the customer, without damage or particular modification,

– The defect reported by the customer does not result from abnormal use of the ordered product, normal wear and tear of the product, or an accidental event possibly caused by a third party.

In the event of confirmation of the coverage decided by The Hunter Camp under this warranty, The Hunter Camp agrees to refund or exchange apparently defective products.

The Hunter Camp will handle the return formalities and will bear the related costs under this warranty.

Any refund decided by The Hunter Camp will be made to the credit card used for the purchase within thirty days following the date on which the returned product is received.

Article 13. Intellectual Property Rights

All elements of the site, whether visual or auditory, are the exclusive property of The Hunter Camp and are protected by copyright. Therefore, any total or partial representation of the site without the express permission of The Hunter Camp is prohibited and constitutes an infringement.

Article 14. Content and Disclaimer

The customer is responsible for entering and verifying the information at each stage of their order, as well as at all stages following the conclusion of the contract.

The Hunter Camp cannot be held responsible for the information provided by the customer at each stage of their order, as well as at all stages following the conclusion of the contract.

The Hunter Camp does not guarantee the acceptance of the customer's order and disclaims any responsibility in the event of unavailability of the ordered product, subject to refunding the customer the price of the ordered product.

The Hunter Camp shall not be liable for any indirect, special, or consequential damages arising from the contract.

The Hunter Camp is in no way responsible for interruptions of the services offered by its site and the consequences that may arise for the user or any third party.

The Hunter Camp is committed to taking all reasonable measures to ensure that the information available on the site is complete and accurate.

However, The Hunter Camp does not offer any guarantee regarding the accuracy or updating of the information on this site, except for the prices mentioned in the order summary before validation.

The Hunter Camp cannot guarantee 100% that all functional aspects of the site are completely free of any execution errors on the hardware that users have chosen to use to access the site and the associated services. However, The Hunter Camp guarantees that all content on the site does not contain any hazardous components.

The Hunter Camp is not responsible for any damages that may result from unauthorized intrusion into its computer systems and/or fraudulent use of its distribution means. It disclaims any liability, particularly in the event of data theft following an intrusion into its computer systems. However, The Hunter Camp implements the necessary measures to prevent illegal intrusions.

By using the Internet in any form or any other means of remote communication to view the site and use the associated services, the internet user and the user acknowledge that they are fully informed and aware of the inherent risks related to the use of the Internet network. The Hunter Camp cannot be held responsible for the presence of a computer virus or any other dangerous content on the Internet that may damage the equipment that the internet user or the user has chosen to use to visit the site and subscribe to the associated services. The Hunter Camp recommends that internet users and users always use updated antivirus and anti-malware software. Users explicitly acknowledge that none of the managers, employees, or any other representatives of The Hunter Camp can be held liable for any damage resulting from visiting the site and using the associated services.

Article 15. Preservation of rights and competent jurisdiction

The Hunter Camp reserves the right to take legal action in the event of a violation of these terms, in order to seek compensation for any potential damage.

Subject to the mandatory rules of public and private international law governing the user, Belgian law governs the relations between The Hunter Camp and them.

The courts of Brussels shall have exclusive jurisdiction.

The Hunter Camp reserves the right to deny any user access to all or part of its site, unilaterally and without prior notice, particularly in the event of a manifest violation of these terms by a user.

Article 16. Miscellaneous

The user expressly acknowledges that the sales contract is concluded in Belgium and that the contractual language is French.

If any provision of these terms is declared invalid or unenforceable under applicable law, that invalid or unenforceable provision will be deemed to be replaced by a valid and enforceable provision that is as close as possible to the original provision, and all other provisions of the agreement will remain in effect.

These provisions and the Privacy Policy represent the entire agreement between internet users, site users, and The Hunter Camp regarding the site and the services associated with it. They supersede and replace all prior or contemporaneous communications and proposals, whether electronic, written, or oral, between internet users, site users, and The Hunter Camp regarding the site and the services associated with it.
