  • "Consent" of the data subject: any manifestation of will, free, specific, informed and unambiguous by which the data subject agrees, by a statement or by a clear affirmative action, to the processing of personal data concerning them.

2. Who is responsible for processing your personal data?

Valapi, Limited Liability Company, hereinafter referred to as "we" or "The Hunter Camp", with company number 0770.425.963 (RPM of Nivelles) and whose registered office is located at 1430 Rebecq, Chemin Longues Aulnes 7, is responsible for processing your personal data.

3. What categories of personal data are processed by The Hunter Camp?

As part of our activities, we may process personal data and/or the following categories of personal data:

6. How long is your data retained?

We are currently working on determining specific rules regarding the retention period of personal data. This period will vary according to different objectives and taking into account any legal obligations to retain certain of your data.

The defined retention periods will allow us to process your requests, ensure their management and follow-up, and carry out our mission, while respecting the principle of proportionality according to which personal data should not be retained longer than necessary to achieve the purpose for which it was collected.

It is specified that all of this data may, however, be retained longer than the periods mentioned in this article:

  • Or, in the form of archives, to meet any legal and regulatory obligations that apply to The Hunter Camp, or during the legal periods of limitation or opposition.

7. Who are the recipients of your collected data?

No personal data is transmitted to third parties who are not part of the aforementioned recipients or do not fall under the indicated legal framework, without prejudice to their possible transmission to bodies responsible for a control or inspection mission under Belgian law, such as an investigating judge.

8. Is your data transmitted abroad?

8.1. Data transfer within the European Economic Area

For the needs of certain processing activities, some data is transferred within the European Economic Area.

Within the European Economic Area, please be aware that your personal data enjoys the same level of protection.

8.2. Data transfers outside the European Economic Area

For the needs of certain processing activities, some of your personal data is transferred outside the European Economic Area.

We transfer your personal data and/or grant access to it to a subcontractor, service provider, or third party located in non-member states of the European Economic Area only when:

  • It is located in a state that ensures an adequate level of protection under an adequacy decision made by the European Commission;

  • Appropriate safeguards have been implemented in accordance with the GDPR, such as:

    • The signing of standard contractual clauses adopted by the European Commission for the transfer of personal data to subcontractors established in third countries (2010/87/EU);

    • The use of approved binding corporate rules; or

    • The application of an approved code of conduct.

Today, the personal data that we transfer directly/indirectly outside the European Economic Area is that processed by various IT service providers (subcontractors of The Hunter Camp) located in the United States (and/or subject to U.S. law).

  1. In light of the recent decision by the CJEU to invalidate the Privacy Shield (the "Schrems II" case), we are closely monitoring the political developments surrounding this decision and the alternatives available to us to continue transferring data to the United States while ensuring an adequate level of protection.

9. What are your rights?

  • Right of access

The right of access is the right you have to obtain, upon request, information about the personal data we hold about you.

  • Right to rectification

This is the right you have to request the rectification, without undue delay, of personal data that may be inaccurate. If you find that personal data is incomplete, you also have the right to request that it be completed.

  • Right to erasure

In certain cases, you have the right to request the erasure of your personal data. This is particularly the case if:

  • the personal data is no longer necessary for the purposes for which it was collected or processed by the data controller;

  • the personal data has been processed unlawfully;

  • the user withdraws their consent and there is no other legal basis for the processing;

  • The user, the data subject, opposes the processing, but in certain specific cases. The right to erasure does not exist in all situations.

  • Right to restriction of processing

In certain cases, you have the right to obtain from us, as the data controller, the restriction of processing of your personal data, in accordance with applicable data protection legislation. For example, when the accuracy of the personal data is contested by the data subject, the processing of the data may be restricted for a period allowing the data controller to verify the accuracy of the personal data.

  • Right to data portability

As needed, you also have the right to receive your personal data in a structured, commonly used, and machine-readable format, under the conditions provided by applicable data protection legislation. In all cases, the right to erasure of data remains applicable. This right only exists if the legal basis for processing is based on Article 6, § 1, a) or Article 9, § 2, a) (consent) or Article 6, § 1, b) (performance of a contract) of the GDPR or if the processing is carried out using automated processes.

  • Right not to be subject to a decision based solely on automated processing

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar way. In other words, you have the right to request human intervention in the processing of your personal data. To this end, we are committed to ensuring that you are never subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar way.

  • Right to object

You have the right to object at any time, for reasons related to your particular situation, to the processing of your personal data if the processing is based on Article 6, § 1, e) (task carried out in the public interest or in the exercise of official authority) or f) (legitimate interests) of the GDPR. In this case, we must cease the processing of personal data unless we demonstrate that there are legitimate and compelling grounds for the processing that override your interests and your rights and freedoms, or for the establishment, exercise, or defense of legal claims.

  • Right to withdraw consent

Insofar as the processing is based on consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on consent before its withdrawal.

11. Is it possible to file a complaint with a supervisory authority?

We will do everything possible to ensure a timely follow-up.

In case our response does not satisfy you, you have the right to file a complaint with the supervisory authority of the state in which you reside, work, or where the alleged violation occurred.

Regarding Belgium, the supervisory authority is the Data Protection Authority (DPA).

12. Changes to this privacy statement
